U.S. CPSC Updates the Safety Standards for Gates and Hook-On Chairs

The CPSC has updated federal safety standards for portable hook-on chairs and gates and enclosures, adopting the latest ASTM 2025 versions. The changes add new requirements for batteries, protective components, warnings, and child-safety design, with both rules expected to take effect in July 2026.
The U.S. Consumer Product Safety Commission (CPSC) is continuing its proactive approach to child safety with two significant updates rolled out in the spring of 2026. Under the Consumer Product Safety Improvement Act (CPSIA), the CPSC regularly reviews and revises mandatory federal safety standards to align with the latest consensus standards from ASTM International.
In late March and early April 2026, the CPSC issued Direct Final Rules updating the Safety Standard for Gates and Enclosures (16 CFR 1239) and Portable Hook-On Chairs (16 CFR 1233). Both updates transition the existing regulations to incorporate the newly published 2025 iterations of their respective ASTM standards.

Safety Standard for Portable Hook-On Chairs (16 CFR 1233)
Published in the Federal Register on March 30, 2026, the CPSC moved to modernize the safety framework for portable hook-on chairs.
The Update: The mandatory standard makes a significant leap, replacing the long-standing ASTM F1235-18 standard with the updated ASTM F1235-25.
Key Changes:
- Electrical and Battery Requirements: Reflecting the growing trend of baby gear featuring integrated electronics (such as soothing vibrations or sound machines), the 2025 standard introduces entirely new safety requirements for batteries, battery compartments, and AC adapters.
- Protective Components: The update adds a formal definition for "protective components" to standardize how manufacturers design and test parts of the chair intended to shield children from pinch points or sharp edges.
- Revised Warnings and Instructions: The standard overhauls the required markings, labelling, and instructional literature to ensure parents have improved guidance on securely attaching and maintaining the chair.
Effective date: Unless the CPSC receives significant adverse comments by April 29, 2026, this rule will also go into effect on July 19, 2026.
Safety Standard for Gates and Enclosures (16 CFR 1239)
Published in the Federal Register on April 1, 2026, the update to 16 CFR 1239 marks a notable shift in the design requirements for expandable gates and self-supporting enclosures used to protect young children.
The Update: The mandatory standard transitions from incorporating ASTM F1004-22 to the newly revised ASTM F1004-25.
Key Changes:
- Elimination of Pet Openings: The CPSC and ASTM determined pet openings pose an entrapment or escape hazard for young children, and they are no longer permitted.
Timeline: Unless the CPSC receives significant adverse comments by May 1, 2026, this Direct Final Rule will become legally effective on July 19, 2026.
